△ 법무법인 지평과 한림출판사Hollym이 영문으로 된 한국의 노동법 안내서 『Labor Laws of the Republic of Korea』를 출간했다.



△ 해외 법인이 한국에 투자할 때 가장 관심을 갖는 분야가 노동법이다. 한국의 노동법은 최근 파견관계, 통상임금, 복수노조, 쟁의행위 등과 관련하여 법도 변경되고 있을 뿐 아니라 판례를 통한 법리가 매우 빠르게 변하고 있다. 그런데 한국의 노동법을 영문으로 제대로 번역하고 있는 책은 거의 없는 실정이다. 외국 기업이 국내 투자를 검토할 때 다른 여건이 충분함에도 노동법을 알지 못해 투자를 망설이는 사례도 있다. 우리나라는 외국의 투자를 유치하기 위해 토지와 세제 등에 있어 많은 혜택을 주고 있지만 정작 외국인 투자자들이 볼 수 있는 영문 번역 노동법을 갖추고 있지 못하다. 가까운 일본만 하더라도 각종 법령과 판례를 모두 영문 번역해 두고 있다.



△ 노동법은 근로자의 근로조건 보호와 관련하여 권익보호와 사용자와의 관계, 근로조건 등을 규정하는 법을 말하지만 대한민국에 규정된 단일 노동법은 없다. 다만 임금과 근로시간, 해고 제한 등 근로 조건의 최저 기준을 정한 '근로기준법', 근로자의 업무상 재해에 대한 보상기준을 정한 '산업재해보상법', 노동조합과 쟁의 조정에 관한 '노동조합 및 노동관계조정법' 등 여러 법에 노동 관련 내용이 포함되어 있는데 이를 망라하여 노동법이라고 한다. 본 도서 『Labor Laws of the Republic of Korea』는 근로기준법과 노동조합 및 노동관계 조정법을 담고 있다.



△ 이 책은 한국 노동법의 대가이자 대법관을 역임하고 법무법인 지평의 고문변호사로 있는 김지형 변호사를 필두로 지평에서 노동업무를 담당하고 있는 변호사들이 내용을 작성하고 외국법자문사(FLC)의 번역과 감수를 거쳤다. 이 한국 노동법 안내서는 한국 노동법에 대해 관심 있는 해외 법인들에게 제대로 된 영문 노동법 서적이 될 것이다. 뿐만 아니라 국내 외국기업 근로자의 권익보호를 위해서도 중요한 역할을 할 것으로 전망된다. 또한 법대생, 로스쿨생, 외국법인에 근무하고 있는 인사담당자들에게 수준 높은 노동법 이론을 제공할 뿐 아니라 노동법의 각종 단어와 표현들을 영어로 경험할 수 있는 기회를 제공할 수 있다. 본 도서가 대한민국 노동법에 대한 세계적인 이해 증진 및 외국 기업과 외국인의 국내 투자 활성화에 기여하기를 희망한다.

Labor Laws of the Republic of Korea, a book is an introduction in English to the labor laws of the Republic of Korea. JIPYONG and Hollym Corp., Publishers have released this book to help non-native Korean speakers and foreign corporations understand how Korean labor law is interpreted and applied in practice. Before this book, there was a lack of publication that ranged over the basics of Korean labor law in a comprehensive manner. Of course, one could refer to The Statues of the Republic of Korea, a book published by the Korea Legislation Research Institute that contains English translations of certain portions of Korean labor law. Up until now, however, it has been difficult to find any one book in English that provides interpretations of Korean labor law and careful analysis of how it is applied in practice.



The Labor & Employment Practice Group at JIPYONG had long represented and advised a wide range of clients, including many foreign clients, on various labor matters. Through the representation of foreign clients, JIPYONG became aware that there was no reference book on Korean labor laws in English, and this made them explore the idea of publishing this book. Today, it becomes clear that Korean labor laws are not just for Koreans but are also for foreigners and foreign corporations. The attorneys and the US attorneys at JIPYONG as well as the US attorneys who specialize in labor law participated in writing this book. Especially a co-author and corporation lawyer of JIPYONG, Ji-hyung Kim has especially maintained his interest in labor law for three decades as a judge, Supreme Court Justice, and member of JIPYONG.



Since this book Labor Laws of the Republic of Korea is intended to introduce the basics of Korean labor laws, it may be limited in extensive coverage of specific legal provisions or issues. However, the publication of this book will trigger others to publish more in-depth examinations of Korean labor laws in English. The literature on laws of a nation, written in languages commonly understood such as English, is an invaluable resource for foreigners in understanding such laws. JIPYONG and Hollym hope that this book can serve as a means by which people can increase their awareness of Korean labor law and how it is used in everyday, real-life situations.

김지형 저자 김지형은 전북 부안 출신. 제21회 사법시험에 합격하여 서울지법 동부지원 판사로 임관한 이후 서울민사지법 판사, 해외 법관연수, 서울지법 부장판사, 서울고법 부장판사, 사법연수원 연구법관 등을 거쳐 대법관에 올랐다. 대법관 퇴임 후에는 모교인 원광대 법학전문대학원(로스쿨)에서 석좌교수, 사법연수원 석좌교수로 지내다 현재는 법무법인 지평의 고문 변호사이자 해밀 노동법연구소장을 맡고 있다.
